If you were a California Citizen on February 1, 2013, and you purchased a Long-Term Care insurance policy from CalPERS that included inflation protection benefits and you were subjected to the 85% premium increase announced by CalPERS in 2013 and implemented in 2015 and 2016, you are entitled to participate this Settlement. Please review the table below to understand if any action should be taken by you and if so by when. Please note that any forms completed after their respective deadline will be deemed untimely and may not be accepted.

The option to select a Replacement LTC Policy passed on September 22, 2021.

Complete the Award Acknowledgment Form by January 28, 2022 (if you did not request a Replacement LTC Policy).

If you do not return your Award Acknowledgment Form, it will be assumed that you have elected to Surrender your CalPERS LTC policy in exchange for a full refund of your premiums.

Category DIn order to receive your Settlement payment, you must complete a Lapse Claim Form by January 28, 2022. If you do not complete the Lapse Claim Form, you will NOT receive any benefits from the Settlement.

Settlement Class Members in Categories B, C, F, G, H, and I will automatically be mailed the Settlement payments that they are entitled to under the Settlement Agreement. If you are entitled to receive an additional year of LTC benefits under the Settlement, you will receive a Schedule of Benefits from CalPERS outlining your increase in coverage.

Subject to the Court’s final approval of the terms of the Settlement, all Settlement benefits are provided in exchange for giving up your claims in this case.

How to File Online:

Online filing is available to Settlement Class Members in Category A, D, and E. To file online, you must log in with the Unique ID and PIN from the email notice you received. After you log in, you will be taken to the correct form to fill out based on your credentials. Please review the form and the information presented to you carefully.

Settlement Class Members in Categories B, C, F, G, H, and I do not need to login.

How to File via Mail:

All eligible Settlement Class Members were sent a claim package with the applicable forms (if any) that needed to be signed and returned to the Settlement Administrator. Copies of some forms, including the Estate Verification Form, can also be found on the Important Documents page for download. Please review the forms carefully, then sign, date, and return to the Settlement Administrator at the address below:
